Our Privacy Policy was updated on January 10, 2023. We have revised the Privacy Policy so that from this date onwards, this Privacy Policy can provide privacy details on how we manage your personal information for Mibro Fit products and services.

INTRODUCTION

Zhenshi Technology (Shanghai) Co., Ltd. and its affiliates (hereinafter referred to as “Mibro Fit App” or “We”) value personal information and give you control over it. We will use strong encryption technology to protect your privacy and develop strict policies to manage all data. When you access Mibro Fit App or use the services provided by us, you are required to agree to this Policy regarding how we collect, use, store and share your relevant information. If you do not agree with provision of this Privacy Policy, please immediately stop using or accessing our products and services.

This Privacy Policy is designed to assist you in understanding what information we collect, why we collect it, and how you can update, manage, export, and delete your information. In case of any doubt about this policy, please contact us at service@mibrofit.com.

1.2.1Device information: We will receive and record the information about the device you are using, such as your device model, OS version, Android id, IDFA, device settings, mobile device version, device identification code, screen resolutions, device environment and other hardware and software features, information about the location of the device, such as IP address and GPS location as well as the sensor information such as WLAN access points, Bluetooth and base stations that can provide relevant information, according to your specific permissions for software installation and/or use. If you refuse to grant us the appropriate permissions during installation and/or use, we will not record your information as described above.

Data such as user profile and watch face when accessing photos, media content, and other files are sensitive information. In order to provide you with a full range of sports experience, with your authorization, our server will extract the video, picture, software name, and version number from your device and upload them to the server for comparison through encryption, so as to match the display features corresponding to the video, picture, and software. Also, you can deny/cancel the permission at any time through related feature settings. Denial of this permission will only prevent you from using the abovementioned features, but will not affect the normal use of other features and services of Mibro Fit App. But after you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.5Scanning QR code and taking photo

When you use such features as scanning QR code, taking photos, shooting videos or shake camera, we will access your device camera-related permission and collect the information you provide based on the pictures and videos uploaded to us after scanning QR code and taking photos. The pictures and videos are sensitive information. If you deny to provide the permission and contents, it will only make you unable to use this feature, but it will not affect your normal use of other features of Mibro Fit App. Also, you can cancel the permission at any time through related feature settings. After you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.6Location information

Bluetooth connection requires positioning permission, and access to weather information requires location permission to obtain phone location information, among which location information is sensitive information. You can permit the enabling of device location feature and use our location-based services, or you can stop our collection of your geolocation information at any time by turning off the positioning feature. You can allow us to access your activity and fitness training records and record step frequency and step count information by reading your activity and fitness training. Also, you can cancel the permission at any time through related feature settings. After you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.7Address book, call history and Mibro Fit App moments

Using the “Add Contact” feature requires access to phone contacts and address book, which are sensitive information. If you want to track your friends’ use of Mibro Fit App, you can apply to use Mibro Fit App-related features. We will upload and save your APP list with your permission, and upload and save the mobile phone numbers of your contacts in the user’s address book in an encrypted way, so as to provide you with special services by matching the information in the server. Also, you can deny/cancel the permission at any time through related feature settings. Denial of this permission will only prevent you from using the abovementioned features, but will not affect the normal use of other features and services of Mibro Fit App. But after you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.8Microphone and recording

When you use the video recording feature, we will access your device’s microphone and recording-related permissions. We need to collect your voice information and voice interaction information. If you deny to provide it, it will only make you unable to use this feature, but it will not affect your normal use of other features of Mibro Fit App. Also, you can cancel the permission at any time through related feature settings. However, after you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.9Bluetooth

If you already have a related hardware and want to synchronize the information recorded by hardware (including but not limited to heart rate, sleep information, steps, exercise data, weight, BMI and other personal information and personal body data that you have agreed to upload) to Mibro Fit App, you can realize this by enabling Bluetooth feature. If you deny to enable it, it will only make you unable to use this feature, but it will not affect your normal use of other features of Mibro Fit App. Also, you can cancel the permission at any time through related feature settings. However, after you cancel this permission, we will no longer collect this information and will no longer be able to provide you with the corresponding services mentioned above. However, unless you delete your information in accordance with the law, your cancellation will not affect the processing and storage of information based on your previous permission.

1.2.10Message notification

After you enable the notification right, when you connect your smart wearable device and enable the feature of receiving notifications on your watch, we will collect the name of the list of applications you have installed (for selecting the application to receive information sources), obtain your incoming calls, SMS, notifications, messages and other notification bar message related data, and obtain the permission to read notifications and Bluetooth so that we can push the content of the notification bar of the mobile phone to the connected smart wearable device via Bluetooth. The operations are performed locally on the device and only for the purpose of achieving your desired notification feature, and the information will not be stored, modified, uploaded or used for other purposes.

1.2.11Control of music playback on mobile client

After the watch is connected to an app, you can use the watch to control the music app on your phone, such as play, pause, go to the previous or the next song, and adjust volume. At the same time, we collect music information (e.g. song name, song playing status, and volume) from your phone and synchronize it to the device. Please rest assured that we will neither save the information about your control actions nor upload this information to the cloud.

1.2.12Incoming call information

When you use the incoming call and SMS notification features, Mibro Fit will obtain the data related to the incoming call, SMS and address book. With your permission, the relevant incoming call, SMS and address book data will be displayed on the band and other devices, but will not be stored by Mibro Fit. In the process of using this feature, Mibro Fit will request access to your contacts permission (which may be called address book permission in some phones), call status, call log permission, phone information permission, and App boot permission to display the phone number and related information of the caller on the device.

If the feature of making and answering calls is supported on your device, you can use the watch to control incoming calls. When the call reminder feature is enabled in the App and the watch is connected to your phone, the watch can display the phone number of the caller and vibrate when an incoming call is made to the phone connected to your watch. In this case, you may choose to decline the call or silence the phone. Please rest assured that the phone number of the caller will only be shown on the watch, and the watch will neither store the numbers, nor will it upload these numbers to the cloud.

4.If you are using an iPhone, we will receive and send your exercise data to HeathKit from Apple with your authorization so as to calculate the amount of exercise. We will read your weight data from HeathKit to simplify your input process. Meanwhile, your exercise data generated in Mibro Fit App will be synchronized with Apple’s HeathKit. Any information obtained through HeathKit, such as weight and heart rate data, will not be shared or sold to any third party, including other agents. We will neither use information from HeathKit in marketing and similar services and nor collect and store any data from your HealthKit in any form or sell it to advertising or other operating agencies.

When you synchronize your data through HealthKit, you may be asked to authorize synchronization or not. This information is managed by iOS and the APP will neither store the health data in any form, nor collect and store your personal health data in any form.

5.If you are using an Android phone, your exercise data generated in Mibro Fit App will be synchronized with Google Fit, such as steps, heart rate, sleep, height and weight data. We will not share or sell the data to any third party, including other agents.

When you synchronize your data to Google Fit, you may be asked to authorize synchronization or not. This information is managed by Android and the APP will neither store the health data in any form, nor collect and store your personal health data in any form.

Cookies and similar technologies are commonly used in the Internet. When you use Mibro Fit App-related services, we may use relevant technologies to send one or more cookies or anonymous identifiers to your device to collect and store your access to and use of Mibro Fit App. We use cookies and similar technologies primarily to enable the following features or services:

We may set authentication and security protection cookies or anonymous identifiers that allow us to confirm whether you are securely logged into the service or have encountered illegal activities such as embezzlement or fraud. These technologies will also help us improve service efficiency as well as enhance login and response speed.

9. Self-Starter Instructions

In order to ensure the stability of device connection experience and data synchronization, when you connect the wearable device, after the phone is turned off and restarted, in order to ensure the connection status between the wearable device and the application, the application needs to connect the device through automatic startup. If you turn off app startup, after you turn off and restart your phone, you won't be able to use message notifications, call reminders, and other related functions if you don't actively open the app again. When the device page is connected to the app, you can turn on and off the app auto-start by viewing the corresponding path in "Enable background operation permission in app protection - select current phone system" on the [My] page in the app.

II.How we update, change, export, and delete your information

1.When you use our products and services, you will be required to provide your true personal information. You shall be responsible for the authenticity, legality, validity and integrity of the information you provide, and for updating and maintaining your personal information in a timely manner to ensure that it is authentic, legal and valid. You can manage your personal information, such as your personal account registration information, at any time.

2.You can delete your content or personal information from your Mibro Fit App account, or request us to delete or modify your information. For example, if you want to delete your personal account, you can contact us at service@mibrofit.com and make your request.

3.In some cases, we will retain data for a limited period of time for legal purposes or legitimate business needs. We will make every effort to ensure that the services of Mibro Fit App can protect information from accidental or malicious deletion. Therefore, if you delete some contents, it may take some time before we delete copies thereof from our current and standby systems.

III.How we protect your personal information

1.All Mibro Fit App products have robust security features built in, and we have established a strict information management policy, equipped with a dedicated technical team, and taken a number of reasonable precautions to protect your personal information from unauthorized viewing, disclosure, misuse, alteration, destruction and loss, including: (1) using encryption technology to ensure that your data remains private during transmission (2) providing a variety of security features to assist you in securing your account; (3) reviewing our information collection, storage and processing practices (including physical security measures) to prevent unauthorized access to our systems; (4) requiring all wakeup employees, contractors, and agents who must have access to personal information to provide the services to comply with the strict confidentiality obligations set forth in the contract strict confidentiality obligations as set forth in the contract, or they may be disciplined or terminated.

We will inform you of the incident-related situation by e-mails, letters, and phone calls. If it is difficult to notify subjects of the personal information one by one, we will issue an announcement in a reasonable and effective way. In addition, we will report and publish the processing of personal information security incidents as required by regulatory authorities.

 

IV.How we handle personal information provided by minors

1.We attach great importance to the protection of minors’ information. In the e-commerce activities, we presume that you have the corresponding capacity for civil conduct. If you are a minor, we ask you to carefully read this Privacy Policy under the guardianship and guidance of your parents or guardians, and use our services or provide us with information with the consent of your parents or guardians.

VIII.Account cancellation-related information and account cancellation processing time limit

1.You can cancel your account by going to “Settings” and clicking “Account Cancellation” in Account and Security. Please read the text prompt on the cancellation page carefully and start cancellation after you agree.

2.Please be aware that after account cancellation, unless your personal information is retained or stored as required by laws and regulations or requirements of regulatory authorities, the account cancellation will take effect immediately. We will delete your personal information immediately.

3.Your cancellation of your account is irreversible. Once your account is cancelled, we will no longer collect personal information about you and/or your children, and we will no longer provide you with products and/or services. All rights and interests generated during the use of the account but have not been used will be eliminated, and the content and information under the account will be deleted, unless otherwise provided by laws and regulations or required by regulatory authorities.
